This privacy policy (the “Privacy Policy”) applies only to the collection and use of Personal Information (defined below) and other information gathered on the website (“Site”) owned and/or operated by or on behalf of Texas Brine Company, LLC (“TBC”). This Site is a commercial website and is intended for use by our customers, and prospective customers and their respective employees and agents to obtain information about TBC’s products. This Privacy Policy explains what information we collect about you, why we collect the information, as well as how we collect and use the information.

This Privacy Policy is intended for individuals in the United States. If you live outside of the United States and choose to use the Site connected with this Privacy Policy, you do so at your own risk and understand that your information will be sent to and stored in the United States. By using our Site or otherwise providing Personal Information to us, you agree to this Privacy Policy.

Capitalized terms used herein without definition shall have the meanings given such terms in our Site Terms of Use. When we refer to “you” or “your,” we mean the person accessing this Site. If the person accessing this Site acts on behalf of, or for the purposes of, another person, including a business or other organization, “you” or “your” also means that other person, including a business organization.

I. The Types of Information We Collect and How it’s Collected

The web servers that serve the Site may gather certain navigational information about where visitors go on our Site and information about the technical efficiencies of our Site and services. As you use the Internet, a trail of electronic information is left at each website you visit. We (or our hosting and other providers) may collect traffic information from visitors for statistical analysis and Site improvement. Our Site may contain links to other websites operated by other parties whose practices may be different from ours. When you click on such links and visit such other websites, you need to be aware that we may not control such other websites or such other websites’ business practices and that this Privacy Policy does not apply to such other websites.

Some social network have features that allow those sites to place cookies on your browser and collect certain of your Personal Information, which may include your name and personal social network account information. These other features are operated solely by the respective third parties and their service providers, and not by TBC. TBC has no control over or access to the information collected, stored or used by such third-party social networks, and the information practices by such third parties are not covered by this Privacy Policy. You should carefully read the privacy policies of each applicable social network before you decide to use such functionalities and features.

II. How We Use Your Personal Information

We may use your Personal Information to help us improve our product and service offerings, to respond to your inquiries and requests, to improve our Site’s functionality, process queries on our Site, to contact you when necessary in connection with products or services you accessed or inquired about via our Site, and to send you information, offers and other promotional materials from us or selected third parties. We use information about our users’ activities and usage of our Site to operate our Site, to improve the quality of the Site, to enhance your experience, to create new services and features, to determine the effectiveness of our Site, and for further internal, commercial purposes. We have employed security measures to reduce the risk of loss, misuse, unauthorized access, disclosure or modification of your Personal Information. IV. Disclosure of Information

Except as described in this Privacy Policy, we do not disclose information about your individual visits to our Site, or Personal Information that you provide, to any outside parties, except when we believe, in good faith, that such release is reasonably necessary to (i) comply with law, or (ii) protect the rights, property or safety of TBC, our users or others. We may also provide your Personal Information and other information that you have provided to us through the Site to other companies that provide services to help us with our business activities such as to host or maintain our Site; for data processing services; to provide website or data security; to provide operational, analytical or reporting services; or to provide technical support.

We consider the information that you provide to us to be a business asset of ours. Accordingly, TBC may also disclose Personal Information and other information to a third party in connection with the sale, assignment or transfer of some or all of the assets of TBC or its subsidiaries or affiliates or as the result of a change in control of TBC, in which case we will contractually require any such third party to treat any such Personal Information in accordance with this Privacy Policy.

We may also disclose Personal Information that you have provided to us to our subsidiary and parent companies and businesses, and other affiliated legal entities and businesses with whom we are under common corporate control. Please note that no attorney/client or similar relationship exists between you and TBC, and therefore no communication between us, or information you provide to us or input via use of a Site, will be subject to any confidentiality obligation or privilege against disclosure.

TBC reserves the right to use and disclose Personal Information to the extent permitted by applicable laws and as necessary for business needs.

V. Correcting or Updating Personal Information

If your Personal Information changes or if you have reason to believe that your Personal Information as we maintain it is incorrect, you may contact us through the Contact Us form and we will attempt to accommodate all reasonable requests for such changes.

VI. Choice/Opt-out

You may request that we delete your personal information.  Note that deletion requests are subject to certain limitations, for example, we may retain Personal Information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests. However, will use commercially reasonable efforts to make the changes and/or deletions you request. Our compliance with such requests may take 30 days or longer. If you give your Personal Information to us again by using the Site or under other circumstances that permit us to use your information, we will regard your opt-out as having been rescinded.

VII. California Resident Privacy Rights

If you are a California resident, you may request (1) information about what Personal Information we have about you, (2) to delete your personal information, and (3) not to sell your personal information. You also have the right to be notified that we may collect your personal information, of the types of personal information we may collect, and what we may do with that information. This Privacy Policy is intended to provide you with such information, but you may always reach out on our Contact Us page for more information. Finally, we will not discriminate against you for exercising your rights under the California Consumer Privacy Act (“CCPA”). We will not make you waive these rights.

We reserve the right to change, modify or update this Privacy Policy at any time without notice. Continued use of this Site after any such revision or modification constitutes your acceptance of this Privacy Policy as so revised or modified.
